Section I: General Terms and Conditions
I.1. Contracting Parties
These Commercial Terms and Conditions bind the Client and the Provider. The Client is an organisation entering into a written contractual agreement with the Provider. The Provider is Noir Noir VOF operating the website “eububblejobs.com” (the “Site”) and providing services of a jobboard, registered in Belgium under KBO number 0803477328.
I.2. Introductory Provisions
These represent the Provider’s Commercial Terms and Conditions, effective as of January 1, 2025. The terms form an integral part of any contract between the Client and the Provider. Contracts are established through written orders, including electronic mail and forms. The Provider has two business days to object to order conditions, after which they are deemed valid. Contracts can also be established when the Client accepts proposed condition modifications. Changes to agreed conditions require the express agreement of the two Contracting Parties.
I.3. Subject Matter of the Performance
The Provider delivers services related to its jobboard business, specifically providing services for advertisers and clients according to specifications in the Order.
I.4. Clients Mentioned in Publications
Clients appear with logo and/or name in the Provider’s electronic publications to ensure transparency.
I.5. Copyright and Trademarks
The Provider holds no liability for copyright infringement consequences.
I.6. Privacy Protection
The Provider protects personal and client information without selling, trading, or renting it to third parties unless specified. The Provider undertakes to maintain confidentiality regarding any dealings connected with the subject of the performance. Given that physical person images constitute personal data under GDPR, clients must comply with data protection legislation. EU Bubble Jobs doesn’t hold any responsibility in the event of complaints concerning misuse of personal data that might arise from the multimedia products created and distributed within the scope of a contract.
I.7. Rates
All service rates exclude VAT, applied according to EU VAT rules.
I.8. Terms of Payment
The Provider may issue invoices upon Order signature. Clients pay for services within the specified period from invoice date to the Provider’s bank account, unless the Order states otherwise. Default payment terms are 15 calendar days after the invoice date.
I.9. Late Payment
Non-payment after reminder permits the Provider to charge interest of 5 per cent per month applied on the amount invoiced from the initial due date, remove advertising materials or client references from the Site, or pursue legal action.
I.10. Defective Service
A service is defective if not performed in accordance with the Order. Otherwise, services are properly performed.
I.11. Complaints
Written complaints must describe defects. If justified, the Provider shall provide a revision of the Service at its own expense.
I.12. Withdrawal from the Contract
Either party may withdraw if insurmountable impediments prevent performance. Withdrawal requires written notice. The Provider holds no liability for non-performance from unforeseeable and unavoidable events.
I.13. Governing Law and Jurisdiction
These terms follow Belgian law with exclusive jurisdiction. Disputes may proceed to arbitration by one arbiter chosen mutually within two months, or each party designates one arbiter who designates a third. The parties will be bound by the findings of the arbiter(s). Proceedings occur in Dutch following Belgian legal principles.
I.14. Severability / Survival / Statute of Limitations
Invalid provisions don’t affect remaining terms. Client causes of action must be filed within one year after the cause of action has arisen, or such cause will be barred, invalid, and void.
I.15. Force Majeure
The Provider bears no liability for delays from circumstances beyond reasonable control, including failure of electronic or mechanical equipment or communication lines, telephone or other problems, computer viruses, unauthorised access, theft, operator errors, severe weather, earthquakes or natural disasters, strikes or other labour problems, wars, or governmental restrictions.
I.16. Changes to these Terms and Conditions
The Provider reserves the right to amend or modify these Terms or impose new Terms and Conditions at its convenience. Acceptance occurs automatically 24 hours after they become effective on the Site. Questions can be sent to hello@eububblejobs.eu.
Section II: Advertising
II.1. Introductory Provisions
These conditions apply to advertisers using the Provider’s advertising services on the Site, partner websites, and newsletters.
II.2. Advertising Services
Services provide advertising specified by the advertiser in the Order and media plan on agreed dates.
II.3. Organisation of Advertising
Advertising is organised by number of weeks, starting on Monday and ending on Sunday the same week, unless agreed otherwise. The Provider sends a proposal mentioning advertising period and position, plus an Order proposal. By signing, the Advertiser undertakes to accept the media plan and the completed Service and to pay the final rate.
II.4. Advertising Exclusivity
Unless explicitly stated, advertising is not exclusive, i.e. the Advertiser shares the same advertising position with other Advertiser(s).
II.5. Creation of Advertising Material
Material is created per advertiser specifications submitted at least five business days before campaign start. Advertisers may provide their own material complying with specifications, or request the Provider design it for a fee. Provider-created material receives two draft versions maximum. Any Advertising Material created by the Provider will remain its own property and may not be re-used without prior written permission.
II.6. Responsibility for the Advertising Material
The advertiser accepts full responsibility for advertising content. The Provider reserves the right not to publish a part or the whole Advertising Material, without any indemnity, even if initially approved, if deemed inappropriate. The Provider doesn’t accept advertisements that expand outside of the designated ad space, without prior written agreement.
Section III: Job Posting
The Provider supports clients’ recruitment needs by publishing job openings on the Site and newsletters. The Provider reserves the right to publish a Client’s job openings on other supporting platforms, in print and online (e.g. Facebook and Twitter). Clients agree to provide necessary information. The Provider may reject postings at its discretion. Job adverts publish within two working days, subject to public holidays and office closure, after they have been ordered at the latest. Clients terminate postings by emailing hello@eububblejobs.eu, with removal within two business days, subject to public holidays and office closure.
